FAQ for Estate Planning, Probate and More
It's not your job to understand laws when you are dealing with estate planning, probate or estate litigation. It's the job of your attorney to provide advice that empowers you to make an informed decision. At Neff & Boyer, P.C., our lawyers have years of experience working with clients throughout southern Arizona. We offer honest advice and strong advocacy for our clients.
Estate Planning And Probate FAQ
If you have questions about planning ahead for the future, the probate process or how to resolve an estate dispute, that's completely normal. The law is complex and at Neff & Boyer, P.C., our attorneys make it a priority to help educate clients on the options they can pursue. Here are a few of the most common questions about estates and probate.
I HAVE A WILL FROM ANOTHER STATE; IS IT GOOD IN ARIZONA?
Yes, a will from another state is still a legal document. However, if you have moved to Arizona, it would be a smart idea to consult with an attorney about making updates to your will or estate plan (if necessary) to protect your interests.
HOW DO I EFFECTIVELY TRANSFER ASSETS?
With a comprehensive estate plan, you can transfer assets to loved ones and minimize the tax implications. The attorneys at our firm can help with your estate plan.
CAN I AVOID PROBATE?
Sometimes (but not always), probate can be avoided. It can depend on whether or not the deceased has a will or died without a will. Our lawyers will carefully review the details of your situation to determine if probate can be avoided.
DO I NEED A WILL OR A LIVING TRUST?
Probate can be avoided by using a living trust (sometimes called a grantor trust or just a trust). However, not everybody needs a trust. Usually, the simple solution is the best. We carefully review your options with you to determine the best solution for your needs.
